    A(n) Personal Chef business using a DBA Doing Business As Trade Name in Montgomery County , i.e., starting businesses using a company name other than the legal (given name) owner's name, need a(n) DBA Doing Business As Trade Name Registration.   For example, you start a(n) Personal Chef business and you call it "Ultra Personal Chef Co". You will need to file a trade firm name for it.

    Also, keep in mind that in Maryland though, a business license and a DBA is necessary for most businesses but if your business sells any taxable items, you will need a sales tax ID number.  (A.K.A state id, wholesale, resale, reseller certificate, about $39 for most states).

    Note: All businesses need a federal tax ID number except sole proprietors that are not employers and are not independent contractors.
    An independent contractor is a self employed business person that receives more than $600 per year from anyone of his or her clients.
    IRS rule: The client must issue a 1099 form to the independent contractor and the independent contractor must have a federal tax ID. However, even sole owners may obtain a federal ID and use it as a business tax ID instead of using their own social security number as a business tax ID number.
    However, all other licenses that apply to sole proprietors as discussed here are requited regardless of getting a federal tax ID number.


    If you are thinking of hiring help, you will need a state employer ID and an IRS number employer ID. I.e., a MD Federal Tax Id Number ($29)  and a(n) MD  State Employer Tax Number  


    Instead of filing a fictitious business name DBA Filing (about $49 plus state and legal newspaper publication fees) in Bethesda, Incorporate in MD  or form a(n) MD LLC


    If you will set up a corporation or form an LLC, you will not have to file a DBA (Doing Business As) unless your corproration or LLC name will be different that the busienss name you will trade under.     Q: Difference Between Personal Chef And Caterer

    Catering vs. Personal Chef Service Personal chefs may be chefs that provide catering. Catering is providing food which a personal chef provides. Since caterers prepare food for individuals, health laws and codes protect consumers. You need to comply with these health laws and then obtain a business license.

    The difference between personal chefs and caterers is that a personal chef does not deliver cooked food to his client. A personal chef prepares and cooks the food in the client’s presence in the client's home or place of business. If the personal chef delivers the food to the client, he must also obtain a caterer’s license. That means that the chef must use a commercially approved kitchen by the health department.

    A: So, if you name your food business “Just A Tad Mouth Watering Personal Chef ” you will need to register the name with an assumed fictitious business name DBA filing. Since a food business is prepared food, then you must charge taxes before selling it – unless you sell it wholesale.

    In either case, you will need a wholesale ID also called a resale license to sell the cupcakes wholesale, buy they wholesale or sell them retail in small amounts.

    All food businesses need a re-seller permit because prepared food is taxable.

    This is because any type of prepared food, is a taxable sales event when it takes place. Other than the food seller permit, you will need an occupational Business License and a filing of a fictitious firm name also called a DBA.

    Here is how to get your Personal Chef Business License for your food business. First, you will need to food certified.

    • Note: In some cases, you will not be able to cook from your house. If they does not let you cook from home, your best bet (only other option in fact) is to find a commercial kitchen restaurant that is health inspected and use it to cook, or at least get a paper from them saying that you will be using their kitchen to cook.

    • Prepare your restaurant, food cart, street food vendor, or food truck for health inspection.

    Health Permit and Food Handler's Permit:

    Environmental Health Department

    Attend a food handler's training course. 
    Pass the food handler's test.
    Receive your health permit and food handler's permit.

    Food Permit from the Environment Department of New Mexico:

    If you are preparing food and serving it directly to customers or producing food for sale to other businesses, you may need a food permit from the Environment Department. 

    Food Permit from the  Environmental Health Department (for temporary food vendors):

    If you plan to operate as a temporary food vendor, you may need a valid food permit from the Environmental Health Department.

    Additional Permits or Licenses:

    Depending on the nature of your personal chef business, there may be other permits or licenses required.

    The permits needed for a personal chef in your case are not clear at first sight because you seem to be in the gray zone of personal chef and caterer, but since you prepare and serve the food at in client's homes, you can get away with a business license, an EIN, and a registration of the business name.

    Your business name, "Jordy the Personal Chef," must be registered with a DBA (doing business as) certificate or alternatively with an LLC or corporation.

    In addition, you must have a food safety course certificate that you can usually obtain online for under $10.

    If you want to be a certified personal chef, you must have at least 1 yr experience and meet continuing education requirements to maintain their certification. You also need a culinary certificate or a high school diploma.

    Community colleges, or culinary schools, can help you earn a 2-year associate's or 4-year bachelor's degree.


    Private Chefs and Catering is part of the food service industry: There are several types of catering services such as: Catering is part of the Food service Mobile Catering Event Catering Box Lunch Caterers prepare food, market it attractively and set up buffet style booths for self-service.

    This business requires a sales tax ID number to buy baked materials and prepared food wholesale and sell it retail at events and or a store. Getting Your Private Chef Catering Business Certified and Licensed, Here is how to get your Business License for your Private Chef catering food business. First, you will need to be food certified.

    That, in most states, is a course you need to take and obtain a certificate.
    • Note: In some cases, you will not be able to cook from your house. Private chefs can get a license to cook at home and finish cooking at the client's place.

    • If they will not let you cook from home, your best bet (only other option in fact) is to find a commercial kitchen restaurant that is health inspected and use it to cook, or at least get a paper from them saying that you will be using their kitchen to cook. You can also say that you are a personal chef and get a chef Business License. In such case, you may be able to prepare the food at your home and finish cooking at your client's location.

    • • If they allow you to cook from home, prepare your restaurant home and kitchen for a health inspection, if not, go with the completed Business License application to the county planning dept including fire sheriff in some cases. These departments will look at the application and will most likely sign it as ok.

    • 4. Most likely, they will send you to the environmental and or health department to make an appointment with them as well to get your catering cooking location inspected and issue you a health permit and a Business License.
    • • Note that in order to sell prepared food as a caterer, you will need to obtain a Seller's Permit tax ID Number, a Business License application -- we will find, complete the application and provide you with the steps to get your food Business License.
    • • In addition, since most likely, you will have a Private Chef trade name for your business, you will also need to register a fictitious business name. Finally, you will need a federal and state employer number for employment withholding for your food handlers employees.
    • • Finally, you can decide to incorporate or form an LLC instead of filing a fictitious business name.
